Case Submission

Innocence Project Delaware provides pro bono investigation and legal services in cases of actual innocence. Because our resources are limited, we only focus on cases where actual innocence can be proven through new evidence. In order to be considered, you must be:

  • Wrongly convicted of a state or federal crime in the State of Delaware

  • Currently incarcerated

  • Unable to afford counsel

  • Finished with your trial and direct appeal

  • Innocent of the crimes for which you are convicted. We cannot accept your case if you played any role in the crime, even a minor one. Additionally, we do not take cases alleging consensual sex, self-defense, or accidental death.

  • New evidence is currently available or discoverable

In order for a case to be considered, a screening questionnaire must be requested and completed. Except where there are issues of literacy or language barriers, we ask that the application be filled out by the individual seeking assistance, not by a friend or family member.

Delaware is a small state with a big wrongful conviction problem.  Innocence Project Delaware is looking to change that.
